TM Tracking Systems Ltd: Terms & Conditions of Product Sale
 
The following terms and conditions are applicable to all orders placed via our website. We have tried to keep these as simple as possible but in case of any queries please contact: enquiries@tmtracking.com
 
Product Pricing
 
All products and prices including special offers are subject to change or discontinuation without notice. Whilst we try to ensure prices and product information are accurate on our web site, we reserve the right to refuse or cancel any orders (even if the payment has been charged) for goods that have been advertised at an incorrect price, showing the wrong photograph or description.
If we discover any pricing errors before we process your order, you will be notified immediately with the option to re-submit your order at the correct price or cancel the order.
 
Product Availability

All products are subject to availability and can change prior to delivery without notice. If this is the case, you will be notified by phone or email.
Any product availability information supplied on our website is an estimate only.
 
Payment.

All prices shown on our web site are exclusive of VAT and are in GBP Pound Sterling for UK and EU purchases. UK VAT is charged on all orders for delivery within the EU. Purchases for non EU customers are zero rated for VAT. Purchases can be made using Visa, MasterCard, or Debit Cards via our secure server.
We have taken every step possible to give our customers the safest shopping experience, however if you are still uncertain about entering your credit card details over the internet, you can also place your order by phone, fax or post. Contact: enquiries@tmtracking.com to find out about alternative payment methods.
 
All credit card orders are subject to validation and checks with the card-issuing bank. TM Tracking Systems  will not be liable if your order is delayed due to these checks. (Please note Non-UK credit card transactions can take longer than normal). Orders can only be accepted from the cardholders themselves. The goods can only be shipped to the billing address of the cardholder unless informed or authorised otherwise by the card-issuing bank.
 
Security.

All payments made via our website use secure server SSL (Secure Sockets Layer). All credit card and payment details are encrypted using industry-standard 128 bit SSL encryption technology with digital certificates from BT, in association with VeriSign, to protect your personal and payment information. We have the most advanced encryption technology currently available for online transactions together with a secure online credit card processing system using Barclays EPDQ.
 
Delivery.

On clearance of payment we can deliver nationwide orders within 7 working days, whilst overseas orders should take no more than 10 working days.
Normally, all orders are dispatched when the order has been processed and ‘Address Verification’ is complete; any delays in these processes may delay delivery times. Product availability may also affect delivery. In case of an extended  delay, you will be notified via e-mail or telephone as soon as possible.
All orders are carefully packed and dispatched from our UK distribution centre and are fully insured against loss or damage. Our normal delivery hours are Monday - Friday from 9.00am to 6.00pm.
 
Warranty.
TM Tracking Systems warrants that upon delivery and for a period of 12 months from the date of delivery the products will:
  • be free from defects in materials and workmanship.
  • be of satisfactory quality.
  • will conform in all material respects with the specification.
 
  • you provide written notice of the defect to TM Tracking Systems  and,if the defect is as a result of damage in transit, to the carrier, within 5 days of the time when you discover or ought to reasonably have discovered the defect.
  • TM Tracking Systems is given a reasonable opportunity after receiving the notice to examine such products and you will use your best endeavours to return the defective product within 15 working days to TM Tracking Systems  at your cost for the examination to take place.
 
 
  • the product is found to be defective at the time of installation or within 2 months of delivery (whichever is the earlier)
  • you report such defect within 5 days of the time you discover the defect
  • prior to the shipment of the defective product you obtain written authorisation for the shipment from TM Tracking Systems.
 
TM Tracking Systems  shall not be liable for a breach of any of the warranty if:
 
  • you make any further use of such products after giving such notice
  • the defect arises because you failed to follow TM Tracking Systems  oral or writ­ten instructions as to the storage, installation, commissioning, use or mainte­nance of the products or (if there are none) good trade practice
  • you alter or repair such products without the written consent of TM Tracking Systems.
 
Any product returned will belong to TM Tracking Systems  and any repaired or replacement product will be guaranteed on these terms for the unexpired portion of the 12 month period.         
 
Note:
Please ensure the goods are in the original packaging and packed safely when returning. After inspection in our warehouse if the goods returned are found not be faulty or in "as new" condition we will charge delivery costs for returning them back to you.
 
Non- Defective Returns.

You have a right to cancel your order in part or full within 14 working days if you change your mind, however, you will be liable for the cost of returning the product back to us. Please notify us via email at enquiries@tmtracking.com All goods must be returned unused, complete and in the original packaging and condition they were supplied in together with any accessories or free gifts provided with the product (all parts , cables, etc must be sealed). All goods must be returned with the original proof of purchase or the order reference.
 
Limitation of Liability – General.
 
TM Tracking Systems  total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this Contract shall be limited to the contract price for the products.
TM Tracking Systems shall not be liable to the customer for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of good­will or otherwise), costs, expenses or other claims for consequential compen­sation whatsoever (whosoever caused) which arise out of or in connection with the supply of product.
 
 Limitation of Liability – Airtime Services.
 
TM Tracking Systems, its officers, employees or other agents will not be liable to their customers in contract, tort or otherwise for:
  • any outage, unavailability or degradation of the Airtime Services due to malfunction of any satellite or other equipment, suspension or termination of the Airtime Services supplied consistently with this Contract, or any other cause, beyond the reasonable control of TM Tracking Systems.
  • any acts or omission of Inmarsat or any of Inmarsat’s appointed distributors or agents that lead to any outage, unavailability or degradation of the Airtime Services.
  • any acts or omissions of a telecommunications carrier unaffiliated with TM Tracking that provides services under this Contract.
  • any outage, unavailability or degradation of the Airtime Services caused by any legal or regulatory requirements of a specific state, province or country.
  • libel, slander, invasion of privacy, infringement of copyright, or other intellectual property rights arising from material transmitted or received via the Airtime Services and beyond the reasonable control of TM Tracking Systems.
  • use of the Airtime Services in a manner not authorized by this Contract.
 
TM Tracking Systems acknowledges that the availability of the Airtime Services, and in particular the ability of any particular Terminal to send and receive messages is affected by various factors including but not limited to, geographical position, environmental conditions, satellite availability or operator error. Consequently, TM Tracking Systems excludes all liability of any kind whatsoever for any losses of whatsoever nature suffered as a consequence of a Terminal being unable to send or receive messages, caused by conditions beyond the reasonable control of TM Tracking Systems. TM Tracking Systems agrees to use reasonable endeavours to rectify any problems in the working of terminals caused by the afore mentioned factors.
 
Data Protection.

We may email you in the future if we have your consent. If you don't want any future emails from us please tick the mailing list box. Your email address will not be passed to third parties unless you agree to join our mailing list.
 
Note: These terms and conditions do not affect your legal rights and we reserve the right to change these terms and conditions at any time without prior notice.
